How does it work?
If you’re a victim of fraud, you can report the fraud to us via our Fraud Report form on our website.
Once you’ve submitted the form, we’ll carefully review your case. In some situations, we may not be able to recover your funds directly. We don’t want to leave it at that. To give you a clear path forward, we’ll ask if you’d like to continue with support from the LAVG, who can guide you through legal steps to try and recover your money.
You have 14 days to decide whether you’d like to proceed. If you do, we’ll take care of requesting the banking details of the fraudster from the counterbank and be in contact to explain the next steps to you.
Please note: In your fraud report, you will be asked to provide the following:
Your Police Report
Summary of payments that you’ve sent to the Dutch IBAN, in form of a transaction statement
Any communication you had with the fraudster
Please note: In case it's a purchase scam: there need to be sufficient police reports filed against the fraudulent merchant, which is visible on this police website.
1. Debt Collection
Once LAVG takes on your case, they’ll begin the debt collection process on your behalf. This comes at no cost to you and you will not get charged. If the fraudsters return your money, you will receive your money back and receive €60 as compensation.
Please note: Recovery isn’t guaranteed — this is dependent on the fraudster and the outcome of the debt collection procedure.
2. Court Procedure
If the fraudster is uncooperative, you have the option to proceed further by filing a lawsuit. During this step, you’ll need to prepay the legal fees for the court proceedings.
If the judge rules in your favor, a bailiff will seize the fraudster’s assets. You will receive your money back and the fraudster will be liable to cover all the legal fees – meaning your prepayment will be reimbursed. LAVG will help you estimate the chances of a successful seizure.
If the judge doesn’t rule in your favour, the prepaid legal fees will not be reimbursed.
What does this service cost?
LAVG works on a ‘no cure, no pay’ basis. This means that the fraudster pays the costs, not you.
There are no costs that you need to pay when:
We request the fraudster’s name, address and place of residence.
LAVG contacts the fraudster to demand payment on your behalf.
You will only be required to pay an upfront fee in the case that you decide to file a lawsuit. This is a voluntary step, which you may decide to take. In such a case, you will need to make a prepayment. If your lawsuit is successful, your prepayment will be reimbursed.
What are the conditions?
